TOP TEMPS PERSONNEL RECRUITMENT
These Terms and Conditions are between Top Temps Personnel Ltd. (‘The Agency’) and the Employer (‘The Client’) and are deemed to be accepted by the Client by virtue of an engagement and signing the temporary staff’s Time Sheet introduced by the Agency.
Definitions: Â In these terms and conditions of Business the following definitions apply:-
‘The Client or Customer’ means the person, firm or corporate body requiring the services of temporary staff.
‘Assignment’ means the period during which the Temporary staff/ worker is engaged to render services.
- The Agency guarantees that all staff supplied by Top Temps Personnel Ltd have been interviewed by qualified personnel and references have been taken up and every effort is made to ensure that staff supplied are of good standard of competence and integrity. At the time of booking , the Client will specify the grade, experience, and qualification of the staff
Required.
- The Client is responsible for the supervision and control of supplied staff for the duration of the assignment. In the event that the staff/employee supplied proves to be unsatisfactory and the booking is more than seven hours, the Agency may reduce or cancel the charge for the time worked by the employee, provided that he/she leaves the assignment within two hours and that notification is given by phone to the Agency and is confirmed in writing by the client within 24 hours.
- The Client is responsible for complying with the provisions of the offices, shops and Railway Premises Act 1963, the Health and Safety at Works Act 1974 and any regulations made under these Acts and will be solely responsible for liability arising there under and indemnity Agency and/ employee against any liability, loss or damage whatsoever arising there under in connection with the assignments of the employee.
- Although every effort is made to select only staff with the best qualities and abilities, we cannot accept any liability whatsoever whether direct, contingent or consequential for any cost, claims, damages, demands or expenses in connection with the introduction of any employee whether from any failure to provide the employee or non-attendance of the employee or from negligent, dishonest, misconduct or lack of skill or incompetence of a employee or from any other cause whatsoever.
- The Agency’s invoices to Clients will be charged in accordance with the scale of charges (Pay rate sheet attached) or as advised to the Client at the time of booking. These will include: – Staff wages, Holiday Pay, Agency’s Commission and travel expenses. THESE CHARGES ARE REVIEWED ANNUALLY OR WHENEVER THERE IS ANNUAL INCREASES IN PAY
NOTE: Our staff are paid weekly. We require our invoices to be paid within 7 days from the invoice date in order to permit us to continue supplying temporary staff as required.
- Each time a client request for an employee from Top Temps Personnel, the Client will be required to sign the Time Sheet. If for some reason client did not sign the time sheet but allow the staff to work for them, the Agency will still charge the Client for the hours worked.
- If within six months of the introduction to the Client of an employee or the completion by the employee of his/her assignments with the client, (whichever is the latter), the client agree to engage or make use of the staff in any capacity, the client is liable to pay an introduction fee of 20% of the annual wage offered plus £50 administration fee to the Agency two weeks before the employee commences the permanent assignment. This fee will apply even if you decide to terminate the employment of the staff because we are making a claim for an introduction fee.
- Public Holiday rates apply on all statutory public holidays whenever the night duty of the bank holiday begins to the end of the holiday. In addition, public holiday rates will apply from 6pm on Christmas EVE and New Year’s EVE.
- No variation in these terms of Business is valid unless confirmed in writing by the Directors of Top Temps Personnel Ltd
- You are responsible for providing adequate insurance whilst the employee is under your direction and control to the extent that any employee supplied and ourselves have benefit of coverage from liability which arises. The employee is deemed to be under your direction and control for the duration of his/her assignments.
